You've probably heard about this case. It started last December when a 15-year-old girl named Kallie Keeler was wrestling in a competition with her high school team. Unbeknownst to her, the person she was wrestling with was a trans identified male.

During the match, Keeler said that the male wrestler had stuck his fingers into her body. She actually stopped wrestling for a second and said so to her mother who was filming the match.

Keeler's mother reported the incident after the match and was told that the other wrestler was a male. The case was considered by a local prosecutor who refused to file charges.

The prosecutor’s office...decided not to prosecute because it concluded that it could not prove that a sex crime was committed beyond a reasonable doubt. Among other things, prosecutors spoke to the referee who officiated the match, and he said that “nothing stood out to him during the match” and that “after watching the video of the match, he could not say that the suspect’s hand placement was ‘anything out of the ordinary.’”

The ref was at a terrible angle to see what happened. But I'm not sure how anyone can miss Keeler's reaction in the video above. Keeler and her mother sued to try to force the school district to limit girls wrestling to girls but "a federal district court and the U.S. Court of Appeals for the 9th Circuit both declined Keeler’s and her mom’s request." So, two weeks ago, the Alliance Defending Freedom made an appeal to the Supreme Court.

“No girl should have to choose between playing the sport she loves and her safety. But the state of Washington forces female athletes like our client Kallie to compete on uneven playing fields against males, violating Title IX’s promise of equal opportunities for girls,” said ADF Senior Counsel and Vice President of Appellant Advocacy John Bursch. “Kallie was just 15 years old when a male wrestler sexually assaulted her. Yet state officials continue to diminish the harm to her, pushing their harmful political agenda ahead of fairness and safety for girls.”

The emergency application for an injunction pending appeal filed in K.M.K. v. Washington Interscholastic Activities Association explains that state officials demand that Keeler “continue competing against males or sit out sports entirely. And they refuse to opt [Keeler] out of matches against males without penalty—or even to give Brown notice of such a match so she may opt [Keeler] out herself.”

Today, Vox published a story warning that this emergency application could result in a major step toward eliminating boys from competing against girls both at the high school and collegiate level.

Broadly speaking, ADF raises two legal arguments against Washington state’s policy allowing trans women to play on women’s sports teams. It claims that Title IX, a federal law that bars “sex” discrimination by most schools, implicitly requires those schools to have sports teams that only cisgender women may play on. It also claims that the Court’s recent decision in Mirabelli v. Bonta (2026), which requires public schools to out trans students to their parents even if the students wish to keep their gender identity secret, also requires those schools to exclude trans women from women’s sports.

Author Ian Millhiser spends several paragraphs arguing that the plaintiffs have no case, but of course the underlying question being raised here is whether schools can play this game of pretending sex and gender ID are interchangeable when it comes to sports teams.

...as the school district argues in its brief, Washington schools do not discriminate on the basis of “sex” — which the Court has defined to mean sex assigned at birth in this context. Instead, they classify athletes on the basis of gender identity. There is one team for all people who identify as male, whether trans or cis, and another team for all people who identify as female. Social conservatives may object to this arrangement, but it does not classify students based on their sex assigned at birth at all.

We don't know what will happen here but this could be a chance for the Court to further limit the ability of blue states to ignore the collective understanding of sex-segregated sports everyone shared until about 10 minutes ago.
